1.1 Commission Process:
All commissions begin with a complimentary rough-sketch session to determine poses, composition, and character details. This initial session allows you to evaluate if my style and vision align with your expectations before proceeding.
1.2 Approval and Confirmation:
Once the initial sketch is approved, a formal quote will be provided. At this point, a 50% non-refundable deposit is required to secure your slot and proceed with the project.
1.3 Payment Requirements:
Full payment must be made prior to the delivery of the final piece. Off-stream commissions will not be completed or delivered until the balance is paid in full.
1.4 Streamed Commissions:
Streamed commissions are available on a first-come, first-served basis during live streams only. Slots cannot be reserved or purchased in advance. Payment is required upfront during the stream to secure your commission.
1.5 Pricing and Surcharges:
The pricing guide and add-ons listed reflect base costs. Additional fees may be incurred based on the complexity of the request or the inclusion of specialty content such as NSFW art (see Section 3.2).
2.1 Revisions Policy:
For off-stream commissions, up to two minor revisions are allowed during the sketch phase. Revisions requested after the sketch phase or additional changes beyond the allotted two revisions will incur additional fees.
Streamed commissions are subject to limited revisions due to the live nature of the work. Minor adjustments may be made upon request, but significant changes may not be possible during the stream.
2.2 Final Approval and Delivery:
Upon completion, high-resolution files will be delivered digitally once the final payment is received. The artwork will be sent in the format specified during the commission process (e.g., PNG, JPG). PSD format is only available upon request and may incur a surcharge.
3.1 General Content Restrictions:
I reserve the right to refuse any commission that I am not comfortable creating or that violates legal, ethical, or community standards. This includes, but is not limited to, hate speech, violent themes, or depictions of illegal activities.

4.1 Personal Use License:
All commissioned artwork is for personal use only unless a separate commercial use license is purchased. Personal use includes social media sharing (with credit), personal website display, and printing for personal display.
4.2 Commercial Use License:
For commercial purposes, such as merchandise, book covers, promotional materials, or monetized projects, a separate license must be negotiated. Please inquire for commercial use rates and terms.
4.3 Artist Rights:
I retain all rights to the artwork, including the right to display it in my portfolio, on social media, and in promotional materials, unless the piece is classified as a private commission. For private commissions, the artwork will not be shared publicly unless express permission is granted by the client.
4.4 Client Rights:
Clients may not claim the artwork as their own, remove watermarks or signatures, or alter the work in any way without my consent. Clients may resize or crop the artwork for personal use, as long as credit is given.
4.5 Prohibited Uses:
The commissioned artwork may not be used for AI training, blockchain technology, NFTs, or any other related technology.
5.1 Client-Initiated Cancellations:
If the client cancels the commission before work begins beyond the initial sketch session, no fees are due. If the client cancels after the initial sketch has been approved and work has started, the 50% deposit will not be refunded.
5.2 Artist-Initiated Cancellations:
If I am unable to complete the commission for any reason, a full refund will be issued to the client, including the 50% deposit. If cancellation is due to abusive behavior, bullying, sexual harassment, stalking, or other misconduct from the client, no refund will be provided, and the client forfeits any claim to the work.
5.3 Refund Eligibility:
Refunds are not available once the final piece has been completed and delivered.
6.1 Availability:
Streamed commissions are only available during live streams and cannot be pre-booked or purchased in advance.
6.2 Content Restrictions:
NSFW content, lewd art, or any material that violates Twitch or community guidelines is not permitted on stream. Artistic nudity is allowed as long as it adheres to platform policies.
6.3 Viewer Engagement and Privacy:
By choosing a streamed commission, the client consents to the artwork being created live and displayed publicly during the stream. If you prefer to keep your commission private, please opt for an off-stream commission.
7.1 Disclaimer of Liability:
I am not responsible for any misuse or misinterpretation of the artwork once delivered. The client assumes all responsibility for the use of the commissioned piece.
7.2 Governing Law:
These Terms of Service shall be governed by and interpreted in accordance with the laws of the state/country in which the artist operates.
8.1 Original Characters and Copyright Compliance:
The Dragon Ossuary specializes in creating original character artwork, including custom D&D characters and other fantasy designs. All commissioned pieces are based on the client’s original concepts, descriptions, or characters. Any similarities to existing intellectual property are purely coincidental and unintentional.
8.2 Licensed Characters and Fan Art:
I do not create artwork of licensed characters from existing franchises (e.g., characters from movies, TV shows, video games, or comics) under any circumstances, including private commissions. This policy is in place to respect copyright laws and the intellectual property rights of others.
8.3 Use of D&D Characters, Monsters, and Items:
I follow Wizards of the Coast’s Open Gaming License (OGL) and will only create artwork of content explicitly permitted under the OGL or System Reference Document (SRD). Any depictions of creatures, items, or characters outside the OGL, such as Beholders or Mind Flayers, are not allowed under any circumstances.
Commissions of original D&D characters (e.g., your homebrew character concepts) are acceptable as long as they are treated as unique, original works that do not infringe upon WotC’s Product Identity or specific copyrighted material.
8.4 Commercial Use Restrictions:
My services do not include the creation of artwork for commercial products, such as merchandise, book covers, or promotional materials that incorporate WotC’s IP. Such uses require separate licensing agreements with Wizards of the Coast.
8.5 Disclaimer of Affiliation:
The Dragon Ossuary is not affiliated with or endorsed by Wizards of the Coast. All D&D-related artwork is created within the scope of personal, non-commercial use and follows the guidelines set forth by WotC’s Fan Content Policy and Fan Site Kit Policy.
9.1 Privacy and Confidentiality:
All client information shared during the commission process will be kept confidential and will not be disclosed to third parties, except as required by law or if explicitly permitted by the client.
9.2 Right to Refuse Service:
I reserve the right to refuse or cancel a commission at any time for any reason. If I initiate the cancellation due to no fault of the client, a full refund will be provided, along with any work completed up to that point in its current stage. However, if cancellation is due to abusive behavior, bullying, sexual harassment, stalking, or any other form of harassment or misconduct from the client, the client will forfeit their refund and any claim to the artwork.
9.3 Payment Methods and Fees:
Accepted payment methods include PayPal, Venmo, or GoDaddy Pay Portal. Payment plans are available for commissions over $150. Any fees associated with certain payment methods or late payments are the responsibility of the client.
9.4 Reproduction and Watermarking Policy:
All final works will include a watermark unless otherwise agreed upon. Clients may not alter, remove, or hide watermarks for public display. Unwatermarked versions may be provided for personal use upon request.
9.5 Rush Fees and Policies:
Rush commissions will incur an additional fee, depending on the complexity and timeline. Rush commissions still include revisions as stated in the Revisions Policy (Section 2). However, if a client does not respond to requests for revision approval or feedback in a timely manner, they will forfeit their rush status, and the commission will be moved to a regular schedule. No refunds will be given in these cases.
9.6 Client Conduct:
Clients are expected to maintain basic courtesy and professionalism throughout the commission process. This includes refraining from abusive language, harassment, or inappropriate behavior (e.g., being gross or overly personal due to the nature of the artwork). Any violation of this policy may result in the cancellation of the commission as outlined in the Right to Refuse Service clause (Section 9.2).
9.7 File Retention Policy:
While I make an effort to retain working files indefinitely, I cannot guarantee that they will be stored long-term. Clients are advised to download and back up all final versions of their commissioned artwork upon receipt, as I may not be able to provide copies at a later date.
By commissioning me, the client acknowledges that they have read, understood, and agree to all terms outlined in this document. The client agrees to abide by these terms and any additional agreements made in writing during the commission process. Any modifications to these terms must be mutually agreed upon in writing by both the artist and the client.
The client also confirms that any content they provide or request does not infringe upon the copyrights or intellectual property rights of others. The client assumes full responsibility for any legal or financial consequences resulting from the use of copyrighted material without permission.
